By purchasing products from iE-BOOKS or using www.ie-books.com, the purchaser agrees to the following terms and conditions.

1. Consumer Protection and other legislation:

This Website and any of the Terms of Use are governed by the laws of Sri Lanka. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Sri Lanka. If any provisions in this Website or the Terms of Use are invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of the Website and Terms of Use which will continue in full force and effect. Where the provisions of any consumer protection law, or any mandatory legislation in your jurisdiction that cannot legally be excluded applies, these terms will be read subject to the application of that legislation, and in the case of any conflict, the provisions of that legislation will apply.

2. Limitation of Liability:

 

The Customer shall indemnify iE-BOOKS against any loss of or damage to property or for data or software which is lost, corrupted, deleted or altered due to the act or omission of the customer. iE-BOOKS will not be liable to the Customer for any incidental, indirect, special or consequential damages arising out of or in connection with the purchase, use or performance of products or services from iE-BOOKS, even if iE-BOOKS has been advised of their possibility. In no case shall  iE-BOOKS's maximum liability exceed the cost of the relevant original order.

3. Refunds:

4. Addressing:

If a product is found to be mis-addressed by iE-BOOKS, then iE-BOOKS will be responsible for the re-delivery, replacement or refunding of the product. If the Customer is found to have given an incorrect or insufficient address/email, then iE-BOOKS will not refund or resend the product and all responsibility for correcting delivery will be borne by the Customer.

5. Prices, Payment and Title:

​

iE-BOOKS's available payment methods will be presented at the time of purchase. iE-BOOKS retains title in the products purchased until iE-BOOKS receives payment in full.

6. Pricing errors:

Although we do our best to ensure prices stated on this website are accurate, errors do occur from time to time. Where a pricing error occurs (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated, and reserve the right to cancel your purchase.

7. Security:

iE-BOOKS uses reasonable endeavors to ensure this website, and any transactions conducted on it, are secure. However you acknowledge that the security of information and payments transmitted via the Internet can never be entirely secure or error free. iE-BOOKS will not be liable for any damages suffered due to failure, delay, interception or manipulation of electronic communications by third parties on any computer programs (e.g. those used for transmission of viruses).

8. Cancelling Orders:

iE-BOOKS reserves the right to cancel orders for any reason or to cancel the purchase agreement after order confirmation, including (without limitation) where         iE-BOOKS believes the order to be fraudulent or constitute a mis-use of a promotional or marketing activity or where an error has occurred including but not limited to errors relating to pricing. If we do cancel your order or purchase agreement, we accept no liability for any resulting damages or costs suffered by you, however we will refund the purchase price to you (where it has already been paid).

9. Consumer License:

iE-BOOKS welcomes you as a valued customer. Because we want to make your shopping experience simple and as safe as possible, you are required to enter into a customer license with iE-BOOKS which explains what we promise to observe and what we require you to observe while using our services, including browsing our site. We may change the customer license from time to time. If we do so, we will post the new version on our site and will email you at the last email address you provided us. Although any change will take place immediately it is posted on our site, we welcome your comments on any such changes. We promise to protect your privacy. Except if required by law, we promise not to divulge any information that you provide to us. We use the information we collect about you to process orders, including calculating the amount payable, and to otherwise communicate with you. That is, you promise not to use any device, software or routine to interfere or attempt to interfere with the proper working of the www.ie-books.com or any of the software that we supply to you for the purposes of providing you with an e-book. You promise not to take action of any kind against us in the event of our termination of this agreement, non-supply, or unfitness for purpose. That is, you release iE-BOOKS, its servants and agents ("us") from any liability if we terminate or suspend your entitlement to use our services. We will only do this if you fail to observe one of these principles. You release us from any liability if we fail to provide you with a service or a product within a reasonable period after you request it. You release us from any liability if the software that we provide to you is not suitable for your existing hardware or software. Some jurisdictions do not permit the disclaimer of implied warranties, in which case this disclaimer will not apply to you. You may have rights additional to this agreement and which vary from jurisdiction to jurisdiction.

Our e-books are sold under license from book publishers. An important condition of the license is that, when you buy an e-book from iE-BOOKS, it can only be used by one individual. Lending and sharing is not permitted. It is not permitted to buy one copy of an e-book and then load it onto multiple devices for several people to use. Nor can you load a book onto a device and then pass the device on to multiple individuals one after another. If you buy an e-book and give it to another person, it is theirs to keep for life. But they may not then lend or share it with another user. If you want to provide, say, 10 copies of an e-book to 10 people, you will need to pay for 10 copies, and then distribute the e-books to those10 people. ​

10. Purchase License:

By purchasing from iE-BOOKS these items ("the Items"), entitled [shown on order page] I acknowledge that:

• I have read the terms of the Customer License which I accepted on [date (being a date inserted by our systems and recorded in it)];

• I have read the Terms of Use of the Website which I accepted on [date (being a date inserted by our systems and recorded in it)]; and

• I further acknowledge that these limitations override (to the extent permitted by law) any right that I might have to use the Items under the copyright legislation in the country of use.

The Marks may not be used as trade marks or in connection with the supply of goods or services by any other person without prior permission in writing by iE-BOOKS. iE-BOOKS has developed strict guidelines as to the manner in which the Marks are to be used by authorised users. You may only provide a link to this Website from a website provided that you link to the home page (//www.ie-books.com or //ie-books.com), and use as the linking text. To link in any other way, you must first obtain the permission from iE-BOOKS.
